II. Information We Collect From You
EngageParkinsons may collect personal and non-personal information about you through your use, or your registering to become a Registered Member, of the website. As used herein, the term “personal information” means information that would allow someone to specifically identify you or contact you physically or online (e.g., your name, physical address, telephone number, or email address).
A. Information We Collect When You Register
If you choose to become a Registered Member of EngageParkinsons, you must provide your email address, and you will be asked to provide certain additional personal or other information. Information you will be asked to provide upon registering include your email address, age, your relationship to Parkinson’s disease (for example, as a diagnosed patient, caregiver, or health care provider), other information related to Parkinson’s disease risk factors or diagnoses (for example, certain genetic, ethnic, or familial information), medications you may be taking, and the zip code of your residential address.
Additionally, we may collect information from you when you communicate with Denali through EngageParkinsons or through the website support teams including those at firstname.lastname@example.org. See below for additional information we may collect when you use the website.
B. Information We Collect When You Use Our Website
We may automatically collect certain technical information from your computer or mobile device when you use EngageParkinsons.
1. Device and Usage Information. We receive information from your device, including IP address, web browser type, mobile operating system version (to the extent applicable), and device identifiers. We receive information about your interactions with the website, such as the time spent interacting with content and the dates and times of your visits.
2. Information from Cookies and Similar Technologies.
a. We may collect information using cookies or similar technologies through your use of EngageParkinsons. Cookies are pieces of information that are stored by your browser or on the hard drive or memory of your computer or other Internet access device. There are several types of cookies, including, for example, browser cookies, session cookies, and persistent cookies. Cookies enable us to personalize your experience on the website, maintain a persistent session, passively collect demographic information about your computer, and monitor other activities. Most major web browsers in default settings will initially accept cookies, but you can adjust your browser’s preferences to issue an alert when a cookie is downloaded, or to block, reject, disable, delete, or manage the use of some or all cookies on your browser or device. Flash cookies, which are cookies based on Adobe Flash, and which may be permanently stored on your device, help store user preferences and activity, and may allow a website to recognize a particular browser or device. b. EngageParkinsons may use other types of local storage (such as browser-based or plugin-based local storage). The website may collect information about your use of the website using scripts. Scripts are pieces of code embedded in the website that define how the website behaves in response to certain keystrokes or mouse clicks (for example, if you click on an embedded link) made by you. III. HOW WE USE YOUR INFORMATION
We use the information we collect about and from you for a number of purposes.
A. EngageParkinsons Maintenance
We may use your website usage data, with or without information you provide us, for general maintenance of the website, measuring the performance of the website, providing you a customized experience, providing and improving the website and making it more useful, analyzing how you use the website, and managing the website network resources.
B. Communications With You
Denali may use your information to communicate with you and respond to your inquiries. For example, we may send email to the email address you provide for informational and operational purposes.
1. EngageParkinsons Updates. If you have registered or elected to receive updates from us regarding our business, products, therapeutic disease areas of interest, services, treatment offerings, research opportunities, or clinical trial opportunities (collectively, “EngageParkinsons Updates”), we will send you these communications. EngageParkinsons Updates may relate to Parkinson’s disease and your relationship to the disease, and research or clinical trial opportunities, where such opportunities may be sponsored by, conducted on behalf of, or in collaboration with third parties, including non-profit organizations, academic institutions, pharmaceutical companies, or health care providers, and such third-party contact or business information.
2. Marketing. We may use information we collect for marketing purposes, such as providing you with promotional materials that may be useful, relevant, valuable or otherwise of interest to you. For example, we may send you promotional materials related to research or clinical trial opportunities, where such opportunities may be sponsored by, conducted on behalf of, or in collaboration with third parties, including non-profit organizations, academic institutions, pharmaceutical companies, or health care providers.
C. Compliance With Applicable Law and Our Own Rights and Obligations
We may also process the information we collect about you, or the information you provide, for the following purposes: (i) perform any right or obligation under, or enforce, our EngageParkinsons Terms or other legal rights, including intellectual property rights, and to research, develop, and commercialize our drug candidates; (ii) as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and (iii) to comply with industry standards and our policies.
D. Aggregate Data
We may de-identify or anonymize (i.e. a form of your information in which you are not identifiable and cannot be contacted) your information, and we may process it in an anonymous and/or aggregated form for other research, clinical, or business purposes than described above.
IV. HOW WE MAY DISCLOSE YOUR INFORMATION
A. Service Providers & Business Partners
We may share your information with our vendors, service providers, and other third parties that perform services related to maintaining and operating EngageParkinsons on our behalf (for example Diffusion Group, LLC ("meltmedia") who help us operate, store data, and maintain the website). These vendors, service providers, and business partners will only receive access to information we collect about you, or that you provide, as needed to provide such services to Denali, as applicable, and such access shall be subject to contracts that protect the confidentiality of the information.
B. As Required by Law and Similar Disclosures
We may disclose information about you: (i) if we are required to do so by law, regulation, or legal process, such as a court order or subpoena; (ii) in response to requests by government agencies, such as law enforcement authorities; (iii) when we believe disclosure is necessary or appropriate to protect against or respond to physical, financial, or other harm, injury, or loss to property or individuals; or (iv) in connection with an investigation of suspected or actual unlawful activity.
C. Merger, Sale, or Other Asset Transfers
We reserve the right to transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets.
We may also disclose your information with your permission.
E. Anonymous/Aggregate Data
In addition, we may share anonymous and/or aggregated reports with third parties. For example, if you contact Denali regarding your experience using one of our investigational or marketed products, we may use the information you provide in submitting reports, alone or in collaboration with our research and development partners, to the U.S. Food and Drug Administration or other similar government agencies such as the European Medicines Agency.
V. YOUR CHOICES AND RIGHTS
You may opt out of receiving related emails from us by following the unsubscribe instructions provided in those emails or by contacting us directly at the contact information given above.
Some of the information you may choose to provide as a Registered Member is the same information that "covered entities" must keep private according to the U.S. Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and its implementing regulations (for example, the medications you may be taking); however, neither Denali nor EngageParkinsons are "covered entities" or subject to HIPAA and its implementing regulations. Further, this website is not meant to serve as a way for Denali to provide safety information related to any of its investigational therapies or clinical trials, nor is it meant to serve as a way for you to provide any adverse reporting information to Denali if you are taking any of its investigational therapies as part of a clinical trial.
VI. HOW WE HOLD AND PROTECT YOUR INFORMATION
We take seriously the trust you have placed in us with your information.
A. Data Retention
We may retain your personal or other information for as long as necessary to comply with our legal obligations, resolve disputes, enforce our rights, or as long as we provide you with the products and services associated with EngageParkinsons. We may delete your personal or other information at any time, except as set forth herein or as required by law.
B. Data Protection
To protect against unauthorized destruction, loss, alteration, access, disclosure, or use (collectively, “Unauthorized Processing”), we maintain administrative, technical, and physical safeguards designed to protect the information you provide and that we collect about you. For example, the website encrypts the transmission of information through EngageParkinsons by using secure transmission technology. Unfortunately, despite these efforts, we cannot ensure or warrant the security of any information you provide to us. In addition, we are not responsible for the security of information you transmit to EngageParkinsons over networks that we do not control, including the Internet and wireless networks. As a result, we will not be liable for any loss or damage arising from any Unauthorized Processing of your information.
VII. HOW WE RESPOND TO DO NOT TRACK SIGNALS
At this time, EngageParkinsons does not respond to or modify its practices in response to browser Do Not Track (“DNT”) signals. Denali is monitoring the development of industry standards for responding to DNT signals and may update its practices should such a standard emerge. VIII. CHILDREN’S PRIVACY
EngageParkinsons is a general audience website intended for use by adults 18 years of age or older only. We do not knowingly collect information online from children under the age of 13. If Denali becomes aware that any person submitting information to the website is under the age of 13, we will promptly take steps to delete any personal information collected and terminate the relevant account. If you become aware that your child or any child under your care has provided us with personal information without your consent, please contact us at the contact information listed below.
IX. YOUR CALIFORNIA PRIVACY RIGHTS
If you are a resident of the State of California, pursuant to Section 1798.83 of the California Civil Code, you may have the right to request the following at any time: (a) information from Denali free of charge regarding how Denali shares certain personal information collected through EngageParkinsons with third parties who use such information for direct marketing purposes; and (b) the discontinuation (or opt-out) of Denali’s sharing of such information with such third parties.
Please submit any such request to the above address, and mark on your request “California Privacy Rights Request” in the subject line, and clearly state the following in the body; the nature of your request; that the request is related to “Your California Privacy Rights”; your name, street address, city, state, zip code, and email address; and whether you prefer to receive a response to your request by mail or email. Denali cannot accept a California Privacy Rights Request via telephone or fax, and is not responsible for a California Privacy Rights Request that is incomplete, incorrectly labeled, or incorrectly sent.
